It appears from this record that appellant and his brother gave appellee two orders, each for one machine and otherwise alike in terms and signed by both, promising to. pay therefor in notes of the tenor specified. The machines were delivered accordingly and appellant gave the notes for his, but refusing to give them for the one delivered to his brother, who died before they were demanded, appellee thereupon, and before the time when they were to be due, brought this suit before a justice of the peace.
