The appellant was indicted for the murder of Garley Grissom and placed upon trial and convicted of aiming *717and pointing a gnn, which gun was discharged, resulting in the death of' the deceased, and sentenced under the provisions of section 1045, Code of 1906 (Hemingway’s Code, section 773).
