General Laws c. 90, § 24(1)(a), as amended through St. 1980, c. 383, prohibits, among other things, the operation of a “motor vehicle” while under the influence of intoxicating liquor. The defendant was arrested and charged with operating a motorized bicycle (moped) upon a public way while under the influence of intoxicating liquor.
