Affirming in part and reversing in part.

Chapter 56 of the Acts of 1908 was an act providing for the government and regulation of. the common schools of the state. By section 17 of that act, which became section 4426a, subsec. 17, of the 1915 Edition of Carroll’s Kentucky Statutes, it was provided:

“The county board of any county shall have power to consolidate, with reference to the needs of either white or colored children, any two or more contiguous school subdistricts, and in case of such consolidation schoolhouses shall be built or acquired,…
