In two actions joined for trial to recover damages for breach of a partnership agreement and for the imposition of a constructive trust, the defendants in Action No. 2 appeal, as limited by their brief, from so much of an order of the Supreme Court, Kings County (Held, J.), dated March 21,1996, as denied their motion to dismiss the complaint in Action No. 2 for failure to state a cause of action.

Ordered that the order is reversed insofar as appealed from, on the law, with costs, and the appellants’ motion to dismiss the complaint in Action No. 2 is granted.
