Appeal from a judgment of the County Court of Albany County, rendered December 8, 1975, convicting defendant, upon his plea of guilty, of the crime of burglary in the third degree and sentencing him, as a second felony offender, to a term of imprisonment with a maximum of four years and a minimum of two years. Indicted by the September 1975 Term of the Albany County Grand Jury for the crimes of burglary in the third degree (Penal Law, § 140.20), grand larceny in the second degree (Penal Law, § 155.35) and petit larceny (Penal Law, § 155.25), defendant ultimately pleaded guilty to the burglary…
