Plaintiff is a Marine sergeant who seeks to enjoin his discharge from the armed services on the ground that the contemplated administrative action is improper and may be judicially challenged under the Declaratory Judgments Act, 28 U.S.C. §§ 2201, 2202, and the Adminis*335trative Procedure Act, 5 U.S.C. § 1009. After granting his request for a temporary restraining order, we held a hearing on plaintiff’s motion for a preliminary injunction.
