About 2 o’clock A. M., March 10, 1885, in the town of Eagle Pass, -Maverick county, the defendant, with a pistol, shot and killed a woman named Josefa Galindo. He was immediately arrested and confined in jail. On June 1,1885, the grand jury returned into court an indictment charging him with the murder. On June 5, 1885, the cause was called for trial, when the defendant presented an application for a continuance, alleging the absence of testimony material to his defense, which application being overruled by the court, the trial was proceeded with and resulted in the conviction…
