At the last term of this court a decision was entered in this case reversing the judgment of the trial court. Upon a proper application a rehearing was granted, and the cause has been a second time submitted for our cou-sideration. The issues involved and the essential facts of the case are stated with sufficient accuracy in the former decision reported in 53 Neb. 67.
