Spinnaker Software Corporation (“appellant”) has appealed an order of the United States Bankruptcy Court for the Northern District of California in which the bankruptcy court denied appellant’s request that Beyond Words Corporation (“Beyond Words”) post a bond before the bankruptcy trustee is allowed to pursue the estate’s claim against appellant. The claim pursued by the trustee arises from a pre-petition agreement (“the agreement”) between appellant and Beyond Words.
