American Commercial Barge Line appeals from a final judgment entered in the District Court for the Eastern District of Missouri holding in part that it was obligated to assume appellee Monsanto Co.’s liability to third parties arising from a barge accident. American Commercial Lines, Inc. v. United States, 590 F.Supp. 816 (E.D.Mo.1984). For reversal, appellant argues (1) there was no actual controversy between the parties under the Declaratory Judgment Act, 28 U.S.C. § 2201, so as to confer subject matter jurisdiction on the district court, (2) the district court…
