Plaintiffs, a former sheriff of Andrew County and the surety on his official bond, sued defendant Andrew County seeking a declaratory judgment to the effect that they were not liable for the repayment of certain moneys which the defendant claims were illegally paid to the sheriff and his deputies. Defendant filed a counterclaim for reimbursement. The case was referred and the finding of the referee for plaintiffs both upon their cause of action and on the counterclaim was sustained by the trial judge. Defendant has appealed.
