The defendant, who was sheriff of Talladega, introduced his deputy, Andrew Lawson, by whom it appeared, that as such deputy, he levied an execution, on the 19th September, 1846, in favor of Joel Dodson, against Weldon S. 1. The declarations of the donor, at' the time he delivered the deed to his father, that he desired the latter to keep his children and the slave in question, and permit the slave and his labor to go towards the support of the donees, was admitted without objection. But it was objected, that the declaration simultaneously made by the do*162nor, that he intended to go to Marengo and settle there permanently, was inadmissible.
