In an action in case, appellee, DeFrates, recovered a judgment for $1,500 against the Central Union Telephone Company, appellant. The first count of the declaration charges that the defendant was the owner of and operating a telephone line near Peoria, Illinois; that the plaintiff was an employe of the defendant, and engaged in stringing, taking off and repairing wires on the defendant’s lines; that on August 6, 1907, the plaintiff was ordered to and went on one of the defendant’s poles for the purpose of taking off certain…
