On August 7, 1947, petitioner-respondent, as. landlord, commenced a summary proceeding in the Municipal; Court of the City of New York to evict the intervener-appellant,' *9as tenant, from an apartment, upon the ground that the term of the lease had expired because the tenant had violated a substantial provision of the lease by permitting others to occupy the apartment. The tenant appeared in person and consented to a final order, which was entered on August 15, 1947, with a stay of issuance of the warrant until November 1, 1947.
