HURT, Presiding Judge.
Appellant was convicted of murder in the first degree, and his punishment assessed at confinement in the penitentiary for life; hence this appeal.
It appears from the record that defendant was indicted in the District Court of Hemphill County, at the May term, 1895, for the murder of Tom T. McGee, alleged to have occurred at Canadian, in Hemphill County, on the 23d day of November, 1894; and at said term of court, at the request of the State and defendant, the venue was changed by the court to Wilbarger County.
