This action is upon a promissory note made by the appellee to the order of the appellant. The defense is based upon the following facts: The appellee gave to the Kemper Grain Company his nonnegotiable promissory note, the words “to order or to bearer” not being contained in the instrument. (Neg. Inst. Law, § 8, Gen. Stat. 1909, § 5254.)
