This case involves the interpretation and constitutionality of K. S. A. 1972 Supp. 21-4616 which authorizes the annulment of a conviction on application of the defendant. The defendant-appellant, Lauren James Miller, having previously been convicted of burglary and grand larceny, sought to avail himself of the provisions of 21-4616 by moving the court for the annulment of that conviction.
