Facts

These three cases have a common factual background and a common issue and will therefore be discussed together. The plaintiff-debtor, Northwest Electric Company of Ohio (“Northwest”), was the electrical contractor on the Trumbull County, Ohio, Mosquito Creek Waste Water Treatment Plant.
