*719In an action, inter alia, to recover damages for wrongful death, the defendant Raul Baez appeals from so much of an order of the Supreme Court, Dutchess County (Sproat, J.), dated March 30, 2005, as denied that branch of his motion which was for summary judgment dismissing the cross claims of the defendants Wheels, Inc., Schering-Plough Corporation, and Sobering Sales Corporation for damages against him to the extent that such damages exceeded the limits of the applicable insurance policy.

Ordered that the order is affirmed insofar as appealed from, with costs.
