Following a trial by jury, Kenneth Justen Shaw was convicted of aggravated battery and aggravated assault but acquitted of obstruction of an officer, charges that arose out of a fight at a Waffle House in Forsyth; he was sentenced to ten years in prison followed by ten years of probation. On appeal from the denial of his motion for new trial, Shaw contends that the evidence was insufficient to support the conviction of aggravated battery.
