MR. JUSTICE ANGSTMAN:

This is a proceeding in mandamus to compel the defendants to execute to petitioner a certificate of sale to certain real estate in Park County.

The facts giving rise to the controversy are these: Defendant "W. P. Pilgeram, as commissioner of state lands and investments, offered for sale at public auction all of section 36, township 3 south, range 7 east, M. P. M., in Park County.
