R. L. Dickison, commissioner of highways of Medina township in Peoria county, (hereafter called the plaintiff,) filed in the county court of Peoria county, a petition to acquire, by condemnation, land for a right of way for a public highway across certain farms in Medina township, including those of John Clark and Hazel E. Kimble. These two owners filed objections and Hazel E. Kimble filed a motion to dismiss the petition. Evidence was heard upon the latter motion and it was overruled.
