This action, which was removed from the New York County Supreme Court, seeks a declaration that certain tax liens asserted by the Government, defendant and third-party plaintiff, against third-party defendant Westchester Wallboard Corporation (“Westchester”) do not attach to monies owed by third-party defendant Gateway Construction Corporation (“Gateway”) to plaintiff, The Flintkote Company (“Flintkote”).
