WIRBARD, District Judge.

On April 8, 1908, a petition for involuntary bankruptcy was filed against Bird, and he. was adjudicated a bankrupt on the 5th day of May, 1908. On June 9, 1906, the Northwestern National Bank of Minneapolis had in its possession a large quantity of promissory notes and conditional sale contracts belonging to Bird, which notes and contracts had been pledged to the bank by Bird, to secure the payment of a debt owing to the bank by him. On the same day — 'June 9, 1906 — almost two years before the petition in bankruptcy was filed, Bird and the Foster-Armstrong Company…
