This is an original proceeding by William Scott Farmer, No. 62439, seeking his release from the state penitentiary at McAlester, by writ of habeas corpus.

Petitioner alleges that he was sentenced by the district court of Tulsa County on *634February 26, 1959 to a term of four years for the crime of burglary, second degree, ,and that he was delivered to the penitentiary on June 25, 1958.
