FONES, Justice.
The State appeals from a decision of the Court of Criminal Appeals reversing and dismissing two (2) convictions for possession of a controlled substance (heroin) for the purpose of resale.
The appellate court held that (1) the trial court erred in not excluding evidence obtained pursuant to a search warrant issued upon the affidavit of a police officer who knowingly made false representations of material facts necessary to obtain the warrant, and that (2) there was insufficient evidence to connect defendant Szeigis to the heroin seized because the State did not prove that…
