S. Sprague brought this action in the district court of Cloud county against the Missouri Pacific Railway *348Company, alleging, in substance, that the defendant was a common carrier, and that on or about the 2d day of March, 1883, for a valuable consideration, the railway company undertook and agreed with the plaintiff to safely carry over its road from Atchison to Concordia certain stock, goods, wares, and merchandise; that he delivered the property mentioned for shipment in good condition at Atchison, but the defendant negligently and…
