CLECKLEY, Justice:
This appeal is brought from a final order entered September 28, 1993, in the Circuit Court of Kanawha County, which dismissed a declaratory judgment action brought by Can-nelton Industries, Inc. (Cannelton), the plaintiff below and appellant herein.
