The plaintiffs, Beatrice Girdler and her spouse, Ronald Girdler, brought this action pursuant to the Federal Tort Claims Act (“FTCA”), 28 U.S.C. §§ 1346(b) and 2671, et seg., seeking damages for injuries sustained by Mrs. Girdler on October 3, 2008, when she fell on the sidewalk next to the defendant Smithsonian Institution’s (“Smithsonian”) National Air & Space Museum (“NASM”).
