Plaintiff appeals from judgment entered on a jury verdict of no cause of action and the subsequent denial of his motion for a new trial.

Plaintiff’s injuries which led to this litigation were sustained December 22,1962, at 3 a.m. At that time, plaintiff was walking on the shoulder of Dort highway, Flint, Michigan, and was struck by an automobile driven by Donald Hughey, one of the original three defendants in the trial court. Plaintiff brought action to recover damages for the resultant injuries against said driver on a negligence theory and he also named as defendants the owners of two bars1…
