Plaintiff, Boulder Plaza Residential, LLC (BPR), appeals the district court's judgment in favor of defendant, Summit Flooring, LLC (Summit), on BPR's contractual indemnity claim. We affirm, and remand the case for further proceedings.
I. Background
In 2000, BPR contracted with McCrerey & Roberts Construction Company, Inc. (MeCrerey) for McCrerey to act as the general contractor on a residential condominium construction project known as One Boulder Plaza (the project).
