This suit was brought by appellee against H. Martin, A. Y. Pace, and the appellant, to recover damages for the alleged conversion by defendants of an automobile truck belonging to appellee.

Plaintiff’s petition alleges in substance that he was the owner of a certain Wichita 2-ton truck which he purchased from the defend‘ant H. Martin about the 25th day of July, 1921, for the sum of $2,050, executing in part payment therefor two promissory notes in the sum of $150 each, dated July 25, 1921, and due, respectively, in 30 and 60 days from date, said notes being payable to the order of H.
