Frank Fitzsimmons, doing business under the name of Fitzimmons Construction Company, entered into a contract with the State Board of Education on May 24, 1916, for the construction of a building known as the women's dormitory, on the grounds of the Normal University, at Normal, Illinois. Fitzsimmons entered upon the construction of the work, but by reason of the alleged wrongful conduct of defendants it was never completed, and he brought this action for damages for breach of the contract.
