The defendant, Harry Smith, on the 23d day of October, 1889, entered into a recognizance before a justice of the peace, in the sum of $500, with the other defendants as sureties, for his appearance on the first day of the February term, 1890, of the Circuit Court of Fayette County, to answer to a charge of an assault with a deadly weapon with intent to inflict a bodily injury, at which term of the Circuit Court he was indicted by the grand jury..
