The above question certified to us by the Appellate Division arose out of the following state of facts: The plaintiff was a helper on an ice wagon. On the 17th day of April, 1920, the wagon was struck in the rear by an automobile, causing the plaintiff severe injuries. The plaintiff filed a notice of election under the Workmen’s Compensation Law [Cons.
