HAMLIN, Justice.

Acting under our supervisory jurisdiction (Article VII, Section 11, Louisiana Constitution of 1921, LSA), we granted certi-orari to review a judgment of the Court of Appeal, Parish of Orleans, (102 So.2d 77), which dismissed the suit of relator, Ralph Dupas; affirmed the judgment of the trial court, insofar as it overruled exceptions of no right of action and ratione materiae filed by respondents, City of New Orleans, et al.; and reversed that portion of the judgment of the trial court which made the alternative writ of mandamus peremptory and ordered respondents to accept…
