LURTON, Circuit Judge.

This is a bill to enforce a deed of trust made by A. W. Lauter and wife to secure a note for $2,000, payable to the Jarvis-Conklin Mortgage Trust Company. This note, before maturity, was assigned to one J. M. S. Armitage, in due course of business, for value, and without any notice of infirmity. The defense was that the note was made to the Jarvis-Conklin Mortgage Trust Company for money loaned in the state of Tennessee, and that that company was a corporation of the state of Missouri, engaged at the time of this transaction in the business of lending money on bond and…
