In 1941, the Government’s civil action against the American Society of Composers, Authors and Publishers (“ASCAP” or the “Society”) for alleged violations of the Sherman Antitrust Act, was settled by the entry of a consent decree (the “1941 Consent Decree”). See United States v. ASCAP, 1941 Tr. Cas. (CCH) ¶ 56,104 (S.D.N.Y.1941). The 1941 Consent Decree was amended on March 14, 1950 (the Amended Final Judgment or “AFJ”), and again on January 7, 1960 (the “1960 Order”).
