Appellant, the Board of Education of the city of Paducah, instituted this suit against the city of Paducah to re'cover $13,634.52, alleged to be due it as a balance under the levy *211made by tbe city council for the year 1896, and $10,988.40, alleged to be due it as a balance under the levy made by the city council for the year 1897, and $2,847.11, subject to a credit of $1,570, alleged to be due it as its pro raba-proportion of the back taxes collected during these years.
