Upon trial by jury in Superior Court, the defendant was convicted of the crime of carrying on his person a knife with a double-edged blade in violation of G. L. c. 269, *771§ 10(b).1 The defendant appeals from an order denying a new trial as well as from the original judgment of conviction.
Testimony at trial. The defendant Albert F. Smith was serving a five to seven year sentence for armed assault with intent to rob and on July 18, 1991, was housed at the Massachusetts Correctional Institution at Norfolk (M.C.I., Norfolk).
