This is an appeal from a decree overruling a demurrer to a bill exhibited by the Valley Land Company, Limited, against the appellant, A. J. Paxton, December 3, 1888, seeking the cancellation of his claim of title to certain wild land in Sunflower county. It is averred that complainant is the real owner of the land, and that the assertion of title by defendant is unjust and injurious to complainant.

Granting the invalidity of the sale of the land for taxes, on the 11th of May, 1870, as claimed by the appellant, and that no title passed to the purchaser under the decree in Green v.
