{¶ 1} Defendant, David Thrasher, appeals from a judgment resentencing him pursuant to State v. Foster, 109 Ohio St.3d 1, 2006-Ohio-856, 845 N.E.2d 470.

{¶ 2} In 2004, following a jury trial, defendant was found guilty of two counts of rape, one count of gross sexual imposition, and one count of abduction. The trial court sentenced defendant to terms of incarceration of nine years on each count of rape and 17 months for gross sexual imposition, and ordered those sentences to run concurrently, for a total aggregate prison term of nine years.
