The defendant, Steve Mitchell, was charged in the county court of Pontotoc county with the unlawful possession of intoxicating liquor, was tried, convicted and sentenced to serve 30 days in the county jail, pay a fine of $200 and has appealed.

It is only necessary in the disposition of this case to discuss but one of the many assignments of error presented in the defendant’s brief.
