MEMORANDUM OPINION

SEAN J. McLAUGHLIN, District Judge.

Plaintiff Daniel T. Galena commenced this action under 42 U.S.C. § 1983, 1 claiming that his rights under the First Amendment were infringed when the Defendant Fiore Leone, then Chairman of the Erie County Council, ejected him from a public meeting of the Council held on March 20, 2007. Following trial, the jury returned a verdict in favor of the Plaintiff in the amount of $5,000.00. Presently pending before the Court is the Defendant’s motion for judgment as a matter of law.
