On 14 October 2009, a jury convicted Darrell Lamar Sullivan, Jr. (“defendant”) of three counts of robbery with a firearm and one count of conspiracy to commit robbery with a firearm. On appeal, defendant contends the trial court erred by (1) denying his motion for appropriate relief without holding an evidentiary hearing; (2) denying his motions to dismiss the armed robbery charges for insufficiency of the evidence; (3) denying his request for a jury instruction on the lesser-included offense of common law robbery; and (4) ordering him to pay $640.00 in restitution.
