KEY, Associate Justice.

—Appellee brought this action for debt, and to foreclose a mortgage on 90 acres of land near Mountain Springs, in Cooke County, Texas. The only defense relied on was that of homestead. There was a nonjury trial resulting in a judgment^ for the plaintiff, and the defendants have appealed.

The land in controversy is a 90-acre farm situated near Mountain Springs. The original mortgage was made January 1, 1889, upon an application therefor signed and sworn to by appellant Isham Mikael October 1, 1888, in which application he stated that the 90 acres of land was no part of…
