Reversing.
The judgment appealed from, was rendered at the -June term, 1916, of the circuit court, and tbe record was thereafter filed in this court, and after tbe order of submission in this court had been set aside on two occasions, was finally submitted, on May 10, 1918. A motion was .made, by the appellees, to strike the bill of exceptions from the record, and this motion was ordered to be passed and to be heard upon the final submission.
