Appeal, No. 36, Oct. T., 1919, by defendant, from decree of C. P. Washington Co., No. 2550, in Equity, on bill in equity in case of John M. Greek v. Matthew Wylie. Bill in equity for an injunction. Before McIlvaine, P. J. The court entered a decree awarding the injunction. Defendant appealed. Error assigned was the decree of the court.

This bill in equity was filed to restrain the owner of land from interfering with certain coal mining operations thereon. In 1902, M. B. Kelso, the owner of a *21two-hundred-acre farm in Chartiers Township, Washington County, conveyed to the plaintiff, John M. Greek, his heirs and assigns forever, all the coal in the Pittsburgh or River vein in a twenty-nine-acre parcel thereof.
