Murphy and another, copartners, doing business under the firm name and style of Murphy & Eyan, against Walter Cooper. This is an appeal from a judgment in favor of the plaintiffs and from an order of the district court of Gallatin county, overruling the defendant’s motion for a new trial.

The action was brought to recover the sum of $2,235.40 as a balance alleged to'be due on an account for work, labor and services performed by plaintiffs in cutting, hauling and delivering railroad ties and other timber, in Bear Canyon, Gallatin county, for the defendant between November 1, 1905, and August 1, 1908.
